MEMORANDUM**
Gary Trudell, a Washington state prisoner, appeals pro se the district court's dismissal without prejudice of his 42 U.S.C. Sec. 1983 action for damages. We have jurisdiction under 28 U.S.C. Sec. 1291, and we affirm. The district court properly dismissed his action without prejudice because a judgment in Trudell's favor would "necessarily imply the invalidity of his conviction" and his conviction has not been invalidated. See Heck v. Humphrey, 114 S.Ct. 2364, 2372 (1994).
AFFIRMED.
