UNITED STATES of America, Plaintiff Appellee,
v.
John Wayne LUNSFORD, Defendant Appellant.

No. 94-6909.

United States Court of Appeals, Fourth Circuit.

Submitted: Nov. 30, 1994.
Decided: Dec. 29, 1994.

John Wayne Lunsford, Appellant Pro Se. Gill Paul Beck, OFFICE OF THE UNITED STATES ATTORNEY, Greensboro, NC, for Appellee.

Before MICHAEL and MOTZ, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

1

Appellant appeals from the district court's order denying his 28 U.S.C. Sec. 2255 (1988) motion. Our review of the record and the district court's opinion accepting the recommendation of the magistrate judge discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Lunsford, Nos. CR-85-113-G; CA-93-482-2 (M.D.N.C. July 19, 1994). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED.
