Larry D. SPEARS, Plaintiff--Appellant,
v.
D. ROSE, L.P.N.; J.W. Short, Sargeant; D.F. Simms; K.A.
Adams, Defendants--Appellees.

No. 95-6487.

United States Court of Appeals, Fourth Circuit.

Submitted May 18, 1995.
Decided July 28, 1995.

Larry D. Spears, appellant pro se. John Britton Russell, SANDS, ANDERSON, MARKS & MILLER, Richmond, VA; Karen Lynn Lebo, OFFICE OF THE ATTORNEY GENERAL OF VIRGINIA, Richmond, VA, for appellees.

Before NIEMEYER and WILLIAMS, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

1

Appellant appeals from the district court's order denying relief on his 42 U.S.C. Sec. 1983 (1988) complaint. We have reviewed the record and the district court's opinion and find no reversible error. Accordingly, we affirm on the reasoning of the district court. Spears v. Rose, No. CA-90-1183-AM (E.D.Va. Mar. 7, 1995). We deny Appellant's motion for appointment of counsel and dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process.
