dissenting. I dissent in this case. The defendants filed only a general denial; and, in my opinion, there is no evidence worthy of credit, that the check was given to either of the defendants. Elliot died in the house occupied by the defendants, and after his death the check, which had been sent to Elliott a day or two before his death was collected by the defendants. I think plaintiff should have judgment for the amount .of the check.
