Succession of Becker

On Rehearing.

MONROE, J.

The residuary legatees apply for a rehearing, on the ground that the decree handed down, affirming the judgment appealed from, makes no disposition of the costs of the appeal. As those costs have been incurred by the appellant, and as the appellant takes nothing by the appeal, they (the costs in question), necessarily follow the judgment on the appeal, and rest where they have fallen.
