Howe, J.After further examination of this case a majority of the court are in .favor, in the interests of justice, of remanding this cause, for the purpose of taking prooí as to the amount of the State debt at the time this contract was made.
It is therefore ordered that the judgment heretofore rendered by us be set aside, that the judgment of the lower court be reversed, and the cause remanded for a new trial at costs of appellees.
