concurring. I concur in the conclusion in this case, on the authority of McCauslaud v. Lyons, 4 An. 273. There may be some doubts as to the correctness of that decision on principle, but it has stood on the books unchallenged for many years, and there seems to be no sufficient reason tor disturbing it.
