(dissenting).

There was sufficient testimony to justify the trial court in submitting the case to a jury under an appropriate charge of comparative negligence which is applicable in this case. This was done, and the jury returned a verdict for the plaintiff. This verdict was set aside by the trial court and judgment entered for the defendants. In my opinion, the judgment should be reversed with directions to enter judgment on the verdict.
