CALOGERO, Justice

(concurring).

In the opinion I authored on the original hearing in State v. Newton, 328 So.2d 110 *927(La. 1976) (a position which did not prevail), I expressed my view that the bribery of voter statute, La.R.S. 14:119, is unconstitutional.

Because the constitutionality of the statute was not attacked in the trial court and being of the view that there are no meritorious bills reserved by defendant, I respectfully concur in affirmance of defendant’s conviction.
