Thomas v. Pepsi Cola General Bottlers, Inc.

BEER, Judge,

dissenting.

I find that plaintiff failed to sustain the burden of proof necessary to establish any disability from November 21, 1975 onward which is related to the alleged injury (itself, very questionable) of September 5, 1975.

Since I do not reach the issues of:

1) legal interest on unpaid compensation, or
2) extent of the employer’s medical services liability,

my dissent does not include — nor is it intended to in any way affect — those aspects of the majority opinion.
