dissenting.

I am not convinced that a public reprimand and probation are, the suitable disciplinary measures to be applied in this case. The charges against respondent are such that, in most cases, would warrant a more severe discipline. I would direct the parties to submit briefs directed to the suitability of the disciplinary measures recommended by the referee, as provided by Florida Bar Integration Rule 11.09(3)(f).
