State, 371 So.2d 712 (Fla. 4th DCA 1979), cert. denied, 383 So.2d 1203 (Fla.1980); Johnson v. State, 249 So.2d 470 (Fla.3d DCA 1971), cert. discharged, 280 So.2d 673 (Fla.1973); and State v. Smith, 118 So.2d 792 (Fla. 1st DCA 1960).
