I respectfully dissent.
Plaintiff was not ever speeding — prior to the accident, she slowed down even further — a cautious maneuver in obedience to a caution light. She saw the defendant’s truck and reasonably believed he would not pull out in front of her. He said he thought he could “beat her across the road” — Airline Highway, no less!
To find plaintiff contributorily negligent is clearly wrong.
