I agree with the decision affirming the trial court in case No. 80-K-0137, State v. Bennie J. Matthews and Thomas Sutton.
I dissent from the reversal in case No. 80-K-2380, State v. Bennie Watkins. The defendant is not immune from rearrest and incarceration pending trial when a legal ground for arrest otherwise existed. I would adopt the concurring opinion of Justice Blanche in State v. Wallace, 392 So.2d 410, 415 (La.1980).
