dissents in part and concurs in part. He dissents from this Court’s summary reversal of the Court of Appeal judgment without opinion, but concurs in the writ grant.
He would simply grant the writ, order the case up and hear and decide with written opinion all of the issues raised, including those not yet addressed by the Court of Appeal.
