State v. Powell

BROWN, Judge,

concurring.

Defendant was a 36 year old third felony offender with an extensive misdemeanor conviction record. The violent nature inherent in armed robbery was aggravated by the stabbing of the victim. Under these circumstances, the trial court was justified in rejecting the modest penalty suggested by the guidelines. The fifty year term imposed by the trial court was fitting for this repeat offender and this life-threatening act.
