concurring.

I agree with the majority opinion in its entirety. I concur only to note that the underlying purpose of the appeal periods is to limit the time the appellant has in which to *9appeal. Viewed in the light most favorable to the defendants for purposes of argument, the worst that can be said of plaintiffs appeal is that it was technically early, prejudiced no one, and did not violate the purpose of the delays for filing appeals.
