concurring in part and dissenting in part:
¶ 66. While I agree with the majority that Goodin’s conviction should be affirmed, I am compelled to dissent from its decision to affirm the sentence of death in the face of serious prosecutorial misconduct during closing argument.
¶ 67. The majority rightly recognizes and condemns the improper argument made by the prosecutor during the penalty phase denigrating the constitutional rights of persons charged with a crime in our country. It concludes, nevertheless, that the error was harmless because the evidence convinces it of Goodin’s “callous indifference to human life.” It is the jury, however, which must determine whether death is the proper penalty, not this Court. The jury should make that determination without being exposed to the type of argument seen here. The death penalty.requires a unanimous verdict of twelve jurors who agree that, taking all factors into consideration, the person on trial should be put to death. See Miss.Code Ann. §§ 99-19-101 & -103 (2000). To the extent that the condemned argument potentially affected a single juror in the decision to approve the death penalty, it was not harmless. See State v. Bey, 137 N.J. 334, 645 A.2d 685, 725-26 (1994) (Handler, J., dissenting) (finding that harmless error standard fails to account for complex value judgments made by jury in penalty phase; “harmless-error rulings cannot properly account for the effect those errors might have on the subsequent determination of the defendant’s sentence’s proportionality.”).
¶ 68. Because I believe that the improper argument here had the potential to affect at least one juror, I would reverse the sentence and remand for a new sentencing hearing.
