I concur in the conclusion of Mr. Justice Brooke upon the first point decided. I am constrained to concur with the conclusion upon the .second point, but upon the ground stated by me in Oakman v. Board of Supervisors, and not upon the ground .stated by Mr. Justice Brooke.
