14 AND DECREED that the government’s motion to dismiss is
15 GRANTED.
16 Defendant-Appellant, Ronald Stein, ("Appellant")
17 appeals from a judgment of conviction entered on May 28,
18 2010, in the United States District Court for the Eastern
19 District of New York (Platt, J.). Appellant pleaded guilty
20 to one count of transportation of images involving the
21 sexual abuse of a minor in violation of 18 U.S.C.
22 §§ 2252(a)(1) and 2252(b)(1). The district court sentenced
23 Stein to 151 months’ imprisonment, a sentence Stein appeals
24 as being procedurally and substantively unreasonable.
25 Appellant pleaded guilty pursuant to a plea agreement
26 in which he waived his right to appeal a sentence of 210
27 months’ imprisonment or below. Stein now argues that the
28 appeal waiver is unenforceable because the district court

1 relied on impermissible factors in sentencing him to the low
2 end of the applicable Guidelines range. Specifically, Stein
3 contends that the district court abdicated its judicial
4 responsibility because the court based its sentence on the
5 mistaken belief that the Guidelines were presumptively
6 reasonable.
7 We held in United States v. Buissereth, 638 F.3d 114
8 (2d Cir. 2011), that although an appeal waiver does “not
9 relieve the District Court of its responsibility to follow
10 the procedural requirements related to the imposition of a
11 sentence, the appeal waiver does preclude this Court from
12 correcting the errors alleged to have occurred below." Id.
13 at 117. Here, the sentencing hearing left much to be
14 desired, and the district judge used less-than-ideal
15 language, but it is evident that, contrary to Stein's
16 contentions, the judge was aware of the fact that the
17 Guidelines are neither mandatory nor presumptive.
18 Furthermore, the court noted that it had considered the
19 facts of the case and the materials presented with regard to
20 sentencing and found that a within-Guidelines sentence was
21 appropriate. Based on our review of the sentencing
22 transcript, we find no extraordinary circumstances like

1 those mentioned in Buissereth that would warrant our finding
2 the appeal waiver unenforceable. Therefore, because we
3 concluded that Stein’s appeal waiver is enforceable and his
4 sentence fell well below the top of the Guidelines range
5 provided for in the plea agreement, we grant the
6 government’s motion to dismiss his appeal as barred by the
7 waiver of appellate rights contained in the plea agreement.
8 For the foregoing reasons, the government’s motion to
9 dismiss is hereby GRANTED.
