Keefe, J.It was stipulated that the gutta-percha is the same in all material respects as that passed upon in United States v. United States Rubber Co. (31 C. C. P. A. 174, C. A. D. 269). In accordance therewith the claim for free entry under paragraph 1697 was sustained.
