I dissent from the judgment, for the reason that the requirement of the statute, that the members of the board shall be appointed from different political parties, is in conflict with section 1 of article 5, and section 4 of article 15, of the constitution.
Minshall J.I have. no apology to make for the decision. I think it is rightly decided on principle. But, if it were otherwise, it is dictated by the force and effect of numerous previous decisions of this court.
