dissenting. I concur in the syllabus, except to the extent that it overrules paragraph one of the *151syllabus of our previous decision. Eor the reasons stated in the opinions of the cases cited in our previous opinion in support of that paragraph one of* the syllabus, I believe that we should adhere to our statement of the law of Ohio as set forth in that paragraph.
