concurs except as to the overruling of the foreman-employee Landrum. case on the authority of the instant case which instead involves an employee-employee relationship —a distinction recognized and approved in the Hume case by two of the present members of this court on the ground that the foreman in the Landrum case was exercising authority delegated to him by his employer and hence was entitled to the same protection as his employer.
