BOOTH, District Judge.

I dissent. The testimony of the two parties to the transaction in controversy was in direct conflict. The circumstantial evidence in part tended to corroborate one, in part the other. No obvious error by the court below in the application of the law is pointed out, and in my judgment there was no grave mistake made in the consideration of the facts. In accordance with the well-established rule applicable under such circumstances, the decree below should be affirmed
