dissents, believing that the doctrine of Boddie v. Connecticut, 401 U. S. 371 (1971), requires reversal of this judgment. See United States v. Kras, 409 U. S. 434, 451 (1973) (dissenting opinion). He is convinced, however, that the Court is so resolutely firm in its contrary view that it would serve no useful purpose to set this case for oral argument.
