For the reasons stated in my dissenting opinion in Gregg v. Georgia, ante, p. 231, I am of the view that the death penalty is a cruel and unusual punishment for*337bidden by the Eighth and Fourteenth Amendments. I therefore concur in the Court’s judgment.
