I concur in that part of the majority opinion holding that thé District Court erred in granting a judgment of dismissal on the third cause of action set forth in plaintiff’s (appellant’s) complaint. In respect to the causes of action in the complaint seeking declaratory relief and rescission, I would affirm the judgment thereon entered by the District Court.
