The chief judge’s very thorough and carefully written opinion affirms the judgment of the district court denying the petitioner’s request for habeas corpus relief. I fully concur in that conclusion and in the reasons stated in support thereof, except for portions of the discussion in part IY. of the opinion. Because I do not subscribe to all of what my brother has written in part IV., I concur, with respect to that portion of the opinion, only in the conclusion that “neither Ohio’s transfer rule nor the court’s transfer decision run afoul of the Constitution.”
