(dissenting). Leave to appeal was not granted in this case. Rather, oral argument on defendant’s application for leave to appeal was heard in order to determine whether this Court should grant leave to appeal, deny leave to appeal, or take other peremptory action. Having heard oral argument, I would deny leave to appeal because I am not persuaded that this Court should take any further action in this unique, fact-specific case that should have no precedential value.
