Lee v. State

RUCKER, Justice

concurring in part and dissenting in part.

I concur in Part I-A of the majority opinion. I dissent however to Part I-B believing there is no relevant distinction between the containers here and the containers in Krise v. State, 746 N.E.2d 957 (Ind.2001), and Halsema v. State, 823 N.E.2d 668 (Ind.2005). I also dissent to Part II because the relative ease with which the police could have obtained a warrant in this case rendered their war-rantless search and seizure unreasonable within the meaning of Article I, Section 11 of the Indiana Constitution.
