(concurring). I concur in affirmance. The unobjected to disposition instruction was not error under People v Cole, 382 Mich 695; 172 NW2d 354 (1969). I write separately only to express my belief that Cole, supra, is bad law. I would urge our Supreme Court to discard the anomaly of Cole and adopt the reasoning of Justice T. E. Brennan in People v Szczytko, 390 Mich 278; 212 NW2d 211 (1973).
