(dissenting).

I respectfully dissent to the majority opinion for the reason that, in my estimation, it allows plaintiff to recover double or treble damages for the permanent injuries sustained by the deceased. To my way of thinking, loss of time and earning capacity, and lasting disability in health, mind or person, are the result of permanent injuries. See my dissenting opinion in Shebester, Inc. v.
