dissenting.

In my judgment, these cases were decided correctly by the court of appeals. State v. Contreras, 674 P.2d 792 (Alaska App.1983). Therefore, I dissent.1

. Despite my dissent, I agree that a general rule is needed, and believe that we should use our rule making authority to develop one. Generally, I would favor a "middle of the road” approach, similar to the one advocated by Justice Matthews.
