Hill, J.

(concurring specially) — I concur in the majority opinion because to do otherwise would be to permit a hard case to make bad law. Because we personally disagree with a prosecutor and a trial judge as to whether a case should have been prosecuted or dismissed, does not make their determination an abuse of discretion.

I can agree with the dissent that their determination was perhaps unfortunate, but I cannot say that there has been an abuse of discretion or reversible error.
