I dissent. I would affirm the judgment for the reasons expressed by Mr. Presiding Justice Ford in the opinion prepared by him for the Court of Appeal, Second Appellate District, Division Three (People v. Caruso, 2 Crim. 12607, filed September 28,1967, certified for nonpublieation).
