dissenting: Without discussing the reasoning of the trial court in rendering the judgment that it did, I wish merely to state that in my opinion the conclusion is inescapable that the undisputed evidence in this case, substantiated by the special findings of the jury, shows conclusively that each of the parties was guilty of negligence which contributed to the accident as a proximate cause and therefore neither is entitled to recover. I would affirm the judgment.
