part). I write separately to express my concurrence with parts n and m of Justice Cavanagh’s opinion. However, for the reasons found in my dissent in People v Stoudemire, 429 Mich 262, 278; 414 NW2d 693 (1987), I respectfully dissent with the analysis appearing in part iv.
