(concurring). I agree wholeheartedly with the majority’s analysis and resolution. I write separately, however, in light of my dissenting colleague’s sentiment that the issue of retroactivity should be addressed by the majority. While I express no opinion regarding the retroactive effect of the decision, I believe that the issue of retroactivity should be addressed in the interests of judicial economy.
