People v. Clark

Cavanagh, J.

(concurring). I concur with the result and reasoning of the lead opinion, with the exception of the harmless error standard. As I articulated in People v Mateo, 453 Mich 203; 551 NW2d 891 (1996), I believe the standard for preserved nonconstitutional error should be judged under the harmless-beyond-a-reasonable-doubt standard. Under this standard, or any other standard articulated by the lead opinion, I believe the error here was not harmless.
