(dissenting). I respectfully dissent. I would not find an abuse of discretion in the refusal of the Recorder’s Court Judge sitting as the magistrate to bind defendant, Shirley Finney, over for trial. There is no occasion to substitute our judgment on the facts for that of the magistrate.1
I would affirm.
