DAY, J.

(dissenting). I dissent and would affirm the conviction.

The defendant never did admit to committing the crime of second degree sexual assault. In fact, he specif icially denied it. I agree with that portion of Justice Ceci’s dissent that would hold that admission into evidence of the defendant’s voluntary statements, follow*675ing what the state concedes was a request for an attorney, was in fact harmless beyond a reasonable doubt.
