I concur in the result because the record supports a finding that appellant consciously disregarded an unjustified and extremely high risk that his actions might cause death or serious bodily harm to another, and *566therefore acted maliciously. See W. LaFave & A. Scott, Handbook on Criminal Law § 70 (1972); cf. 18 Pa.C.S. §§ 302(b)(8), 2501(a) (1973); compare Model Penal Code §210.2 (1974).
