On Appellees’ Motion for Rehearing.
In this case the appellees filed their motion agreeing to amend the motion in the particulars mentioned in our opinion, but the tender to do so was met by a motion by appellant Ball for a rehearing on the whole case, with a prayer for the rendition of the judgment in his favor. Likewise, John T. Lomax, appellant, filed a inotion for a rehearing and praying a reversal of the case as to him.
For the reasons given in the opinion of the court in this case, no proper judgment can be here rendered. The judgment of the trial court is reversed, and the cause is remanded for a new trial between all the parties.
Reversed and remanded.
