We have reviewed the record and the magistrate judge's opinion and find no reversible error. Accordingly, we dis- miss the appeal on the reasoning of the magistrate judge and be- cause the appeal is frivolous. United States v. Ashe, No. CR-92-191 (M.D.N.C. Sept. 25, 1996). We dispense with oral argument because the facts and legal contentions are adequately presented in the ma- terials before the court and argument would not aid the decisional process. DISMISSED 2
