We have reviewed the record and the district court's opinion and find no reversible error. Accordingly, we deny a cer- tificate of appealability and dismiss the appeal on the reasoning of the district court. United States v. Howery, Nos. CR-92-116-A; CA-96-1104-AM (E.D. Va. Sept. 16, 1996). Howery's motion for bail pending appeal is denied. We dispense with oral argument because the facts and legal contentions are adequately presented in the ma- terials before the court and argument would not aid the decisional process. DISMISSED 2
