Coleman v. Kilpatrick

I dissent. The trial court did determine who owned the driveway. The trial court's description declared that the Colemans owned a one-foot strip on the west side of the disputed strip and that the Kilpatricks owned a one-foot strip on the east side of the disputed strip.

The trial court found that "[t]he [Colemans] have record title to the disputed area" and awarded to each party "a non-exclusive continuous and unimpeded right of way by prescription or user in the disputed area." *Page 792
