Pointer v. State

I would affirm the trial court's judgment on all points. Therefore, I dissent to say that § 20-2-93(a)(8), Ala. Code 1975, is clear. The result may seem harsh under the facts of this case; however, Pointer was growing and cultivating marijuana, marijuana was found in his house, and he admitted selling marijuana to "make a living." The trial court heard all the evidence and, pursuant to the statute, ordered a forfeiture. I would affirm the trial court's judgment ordering forfeiture.
