PER CURIAM: Appellant appeals the district court's order adopting the re- port and recommendation of a magistrate judge, granting Appellee's motion to dismiss, and denying Appellant's motion for summary judg- ment. We have reviewed the record, the magistrate judge's report, and the district court's opinion and find no reversible error. Accordingly, we affirm on the reasoning of the district court. Hensley v. Callahan, No. CA-96-1925 (S.D. W. Va. Aug. 18, 1997). We dispense with oral argument because the facts and legal conten- tions are adequately presented in the materials before the court and argument would not aid the decisional process. AFFIRMED 2
