Accordingly, we deny a certifi- cate of appealability and dismiss the appeal on the reasoning of the district court. See United States v. Fuell, Nos. CR-93-138-R; CA-96-1043-3 (E.D. Va. June 7, 1999). We dispense with oral argu- ment because the facts and legal contentions are adequately pre- sented in the materials before the court and argument would not aid the decisional process.
